$1.6 Million Offered in Slip & Fall Injury Lawsuit
Monday, May 03, 2010
Sheri A. Gostomski's attorneys recently resolved her personal injury
lawsuit. Gostomski, who suffered a serious back injury in a
slip-and-fall accident at her place of work, was offered $1.6 million
dollars by the defendants in an effort to settle the case.
Gostomski was working for Loeffler Beauty Supply in Hamburg, N.Y.,
at the time of the accident, which occurred Aug. 14, 2003. While
working, she slipped in a puddle of water present in the store and fell.
The fall caused a herniated disc in Gostomski's back, ultimately
requiring multiple surgeries to correct. The problem was known to the
owners of the building, Benderson Development Co. Benderson Development
had stated that they would fix the problem, but had not by the time of
the accident and injury.
Benderson Development is currently one of the largest strip center developers in the United States. It is also one of the single-largest private development companies in North America as a whole, with interests in both retail development and power center development.
Ms. Gostomski's attorneys were Dylan Brennan and Gregory Pajak of the law firm Cellino & Barnes. Cellino & Barnes is one of the largest personal injury representation firms in the United States of America, and both attorneys have significant trial experience.
"The slip-and-fall injury that our client suffered is a surprisingly common occurrence, with many victims such as Ms. Gostomski suffering serious injuries as result of the negligence of a property or business owner," said Brennan. "We're pleased that we were able to secure a settlement for her in this case, which will compensate her for her medical bills and other costs related to the injury."
Ms. Gostomski's case has been ongoing for nearly seven years at this point. While it seems like a long time, this is not entirely uncommon in personal injury cases, and partially explains the high value of the settlement reached, as the plaintiff's medical bills have grown the longer she receives treatment.
